Terms of Service

By using Obiolink (“Obiolink,” “we,” or “company”) services, you agree to these Terms of Use (“Terms”). These Terms apply to our website, obiolink.com, our administrative panel, subdomains, and all products/features we offer (collectively, the “Service”). For privacy provisions, see our Privacy Policy.

Summary: Obiolink allows you to create, customize, and measure the performance of your link-in-bio pages. You are responsible for your account and the content/links you publish. Inappropriate use may result in your account being suspended. Paid plans operate on a renewal basis; you manage the cancellation.

1) Parties and Contact

These Terms: This agreement is between Obiolink and you (whether a natural person or the legal entity you represent). If you are registering on behalf of a company, you represent that you have the necessary authority.

2) Agreement Establishment and Changes
Creating an account, using the Service, or providing an acknowledgement such as "I Accept" constitutes your acceptance of the Terms. We may update the Terms from time to time; we will post the most current version on the site. We will endeavor to provide reasonable notice of significant changes. Your continued use of the Service after changes constitutes your acceptance of the new version.

3) Account and Access

Accuracy & Security: You are responsible for ensuring that your registration information is accurate and up-to-date and for protecting your password. Actions taken through your account are attributed to you.

Authorization: For corporate accounts, you are responsible for all actions taken by users you authorize.

Unauthorized Use: If you detect suspicious/unauthorized use, please notify us immediately.

4) Scope of Service and Changes
Obiolink; It offers components such as links, buttons, icons, themes/branding, multilingual text, embedded media, countdowns, QR codes, analytics, and calendar publishing. We may update the feature set, replace it with equivalent/similar functionality, or discontinue some features without prior notice. Beta/experimental features are provided "as is" and may not always be stable.

5) Third Parties and Integrations
The Service may work with third-party services such as hosting, CDN/WAF, email, payment, analytics, and similar services. Furthermore, the links and embedded content you add to your pages belong to third parties. We are not responsible for the content or privacy/cookie practices of these parties; you should review their respective policies.

6) Acceptable Use Policy (AUP)
You may not use the Service for:

Applicable unlawful, fraudulent, or deceptive activities;

Malicious code, spam, phishing, abuse, or excessive traffic exceeding system/scale testing;

Hate speech, calls for violence, harmful content to children, pornographic/obscene content;

Content that violates the intellectual/industrial property rights, personal rights, or privacy of others;

Misrepresenting your identity/affiliation; Reselling, renting, or unauthorized repackaging of the Service;

Bypassing security measures, reverse engineering, or unauthorized API/automation;

Malicious link redirects, ad fraud, fraudulent UTM/analytics manipulation.

In the event of noncompliance, we may take appropriate measures, including suspension and/or termination with or without notice.

7) Content Responsibility
You are responsible for all content/links on the pages you create with Obiolink. You guarantee the accuracy and legality of the content, and that you have obtained the necessary permissions and licenses. You are responsible for all responsibilities and expenses arising from third-party claims (copyright, trademark, personality rights, etc.).

8) Intellectual Property

Our Rights: We own all intellectual property rights, including the Obiolink brand, software, designs, data models, and documentation. License: You are granted a personal/corporate, non-transferable, non-sublicensable, limited right of use.

Your Rights: You retain the rights to the content you add to your pages. You grant us a worldwide, royalty-free, non-transferable, limited use license to provide, host, back up, and secure the Service.

9) Fees, Plans, and Payments

Plans: We offer free and paid plans. Plan scope and limits are specified on the website.

Renewal: Paid plans automatically renew at the end of the billing period unless canceled.

Payment: Amounts inclusive of taxes/duties will be billed. Service may be suspended in the event of unsuccessful collection.

Cancellation & Refund: Cancellation mid-term does not require a pro rata refund for that period (subject to mandatory consumer protection legislation).

Change: We will post fee/plan changes with reasonable notice; they will take effect in the next term.

10) Custom Domain and DNS
If you use a custom domain, you are responsible for ensuring the correct DNS, SSL, and redirect settings. If we provide automatic SSL/HTTP settings, they are provided "as is" and only for technical compliance. Any disruptions resulting from incorrect DNS/SSL configurations are your responsibility.

11) Analytics, UTM, and QR
Analytics data is derived from clicks, source channels, device information, and UTM parameters. This data is approximate/statistical and does not guarantee 100% accuracy. QR code scans are also logged for analytics. Details are in the Privacy Policy.

12) Data Protection, Roles, and DPA
Your privacy is protected by the KVKK/GDPR principles (detail: Privacy Policy).

You are the data controller for your own page's visitor data; Obiolink acts as the data processor.

You may request a Data Processing Agreement (DPA) in this context.

13) Service Support and Maintenance
We provide support with reasonable efforts and provide advance notice of planned maintenance/improvements whenever possible. In the event of data loss/inaccessibility due to maintenance or unexpected interruptions, we will perform backup and restore processes in good faith; however, we cannot guarantee uninterrupted operation or data recovery.

14) Suspension and Termination

Termination by you: You may terminate the contract at any time by canceling from the dashboard.

Termination/Suspension by us: We may suspend or terminate your account in the event of non-compliance, payment failure, legal obligation, or security risk.

Consequences: Upon termination, your access will be terminated. Subject to applicable legislation and technical requirements, your data will be deleted/anonymized within a reasonable timeframe. We will endeavor to provide a reasonable data export facility upon request.

15) Disclaimer
The service is provided "as is" and "as available." We make no express or implied warranties of fitness for a particular purpose, uninterrupted use, error-free operation, or compatibility with third parties.

16) Limitation of Liability
To the maximum extent permitted by applicable law:

Obiolink is not liable for indirect, incidental, special, or consequential damages (loss of profits, loss of reputation, loss of data, etc.).

Our total liability for direct damages shall not exceed the total amount paid by you in the last 6 months of the relevant claim.

Mandatory consumer protection provisions are reserved.

17) Indemnification (Indemnification)
You agree to hold us harmless from any reasonable damages/losses/costs incurred by Obiolink due to your violation of these Terms, your content, or any third-party claims.

18) Infringement Notifications (Copyright/Personality Rights)
You may report content/links you believe to be infringing to [legal@obiolink.com], along with documentation and URLs related to your rights. We utilize removal/removal processes for appropriate applications.

19) Force Majeure
We are not responsible for the disruption of our obligations due to events beyond our control, such as natural disasters, war, terrorism, strikes, infrastructure failures, supplier interruptions, or legal/administrative proceedings.

20) Governing Law and Jurisdiction
These Terms are governed by the laws of the Republic of Turkey. The courts and enforcement offices of Istanbul (Central) have jurisdiction in disputes. Mandatory local regulations protecting consumers are reserved.

21) Transferability, Waiver, and Severability
You may not assign your rights and obligations under these Terms without the written consent of Obiolink. We may assign them in the event of a business transfer/merger. Failure to exercise any right shall not be deemed a waiver. If any provision is invalid, the remaining provisions shall remain in effect.

22) Entire Agreement
These Terms, together with the Privacy Policy and DPA (if applicable), constitute the entire agreement between the parties and supersede any prior representations.
